These Terms and Conditions govern the access and use of the Solximo platform, operated by Solximo SpA, a company incorporated under the laws of the Republic of Chile.
1. Acceptance of terms
By accessing and using the Solximo platform, you accept these Terms and Conditions in their entirety. If you disagree with any of these terms, we ask that you do not use our services. Continued use of the platform constitutes acceptance of any subsequent modifications to these terms.
2. Service description
Solximo is a real estate crowdlending platform that allows users to collectively invest in construction and urban development projects in Chile. The platform acts as an intermediary between investors and real estate developers, facilitating fund management and profit distribution.
3. Participation requirements
To use Solximo's investment services, you must: be at least 18 years old; hold a valid Chilean RUT or residence permit in Chile; provide truthful and up-to-date information; complete the identity verification process required by Chilean regulations; accept the inherent risks of real estate investments.
4. Investments and risks
Investments made through Solximo carry risks. Past performance does not guarantee future results. Real estate projects may be affected by market fluctuations, construction delays, regulatory changes, or other unforeseen factors. Solximo does not guarantee specific returns on investments made.
5. Commissions and costs
Solximo charges commissions for investment intermediation, which will be clearly and transparently disclosed before the user confirms their participation in any project. Associated costs are detailed in the specific documentation of each project available on the platform.
6. Intellectual property
All content on the Solximo platform, including texts, graphics, logos, images, software, and design, is protected by Chilean intellectual property laws. Reproduction, distribution, or modification of content without express authorization from Solximo SpA is prohibited.
7. Limitation of liability
Solximo shall not be liable for financial losses arising from investments made by users, investment decisions based on information provided on the platform, temporary service interruptions due to maintenance or force majeure, or actions by third parties affecting project development.
8. Applicable law and jurisdiction
These Terms and Conditions are governed by the laws of the Republic of Chile. Any dispute shall be submitted to the jurisdiction of the ordinary courts of justice of Santiago, Chile, with the parties waiving any other jurisdiction that may correspond to them.
